1. Agreement to these terms

These Terms and Conditions ("Terms") govern your access to and use of Spendtrakkr ("Spendtrakkr", "we", "us", or "our"), including the website at www.spendtrakkr.com and the Spendtrakkr application. By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use Spendtrakkr.

2. What Spendtrakkr is

Spendtrakkr is a reporting and analytics platform for advertising agencies. With your permission, we connect to your advertising accounts (such as Google Ads and Meta Ads), retrieve your campaign performance data on a read-only basis, and present it back to you in dashboards and reports. We do not create, edit, pause, or otherwise manage your campaigns.

3. Eligibility and your account

• You must be at least 18 years old and able to enter into a binding contract.
• You are responsible for the activity that happens under your account and for keeping your login details secure.
• You must provide accurate information and keep it up to date.
• Access during early access is granted at our discretion and may be invite-only.

4. Connecting advertising platforms

When you connect a Google Ads or Meta Ads account, you authorise Spendtrakkr to retrieve your reporting data through those platforms' APIs. Your use of Google and Meta remains subject to their own terms and policies, and you confirm you have the right to connect the accounts you add. We access your data only after you grant permission, and only on a read-only basis. You can disconnect a platform at any time from your settings.

5. Acceptable use

You agree not to:

• Use the service in breach of any law, or of Google's or Meta's terms.
• Access data or accounts you are not authorised to access.
• Attempt to interfere with, disrupt, reverse engineer, or gain unauthorised access to the service or its systems.
• Resell, sublicense, or misrepresent the service as your own.

6. Plans and fees

During early access, Spendtrakkr may be provided free of charge to selected users. Paid plans may be introduced in the future. Where fees apply, they will be described at the point of purchase, and we will give you reasonable notice of any changes to pricing that affect you.

7. Your data and privacy

How we handle your data is described in our Privacy Policy and our Cookie Policy. You retain ownership of your data. You grant us the limited permission needed to retrieve, store, and display it so we can provide the service to you. We do not sell your data.

8. Availability and no warranty

We work hard to keep Spendtrakkr reliable, but the service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error free, or that the data shown will always be complete or accurate, as it depends on third-party platforms. Reporting is provided for informational purposes and should not be your sole basis for business decisions.

9. Intellectual property

Spendtrakkr, including its software, design, and branding, is owned by us and protected by law. These Terms do not transfer any ownership of the service to you. Your data remains yours.

10. Suspension and termination

You may stop using Spendtrakkr and disconnect your accounts at any time. We may suspend or terminate access if you breach these Terms, if required by a third-party platform, or to protect the service or other users. On termination, your right to use the service ends. You can request deletion of your data as described in the Privacy Policy.

11. Limitation of liability

To the maximum extent permitted by law, Spendtrakkr will not be liable for any indirect, incidental, or consequential loss, or for loss of profits, revenue, or data, arising from your use of the service. Nothing in these Terms excludes rights you may have under the Australian Consumer Law or other rights that cannot lawfully be excluded.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will change the date at the top of this page and, where appropriate, let you know. Your continued use of the service after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia.
